I'm at a stop light waiting to turn, an illegal alien rear ends me, stands and argues he didn't even as I point out the damage, He was speaking in broken (very) english and mostly spanish. then he tried to drive off hitting another car! next while we two citizens are collecting info he calls some one they come out pick him up and abandon the car. I contact my insurance and they tell me I have to pay MY deductible to repair my car that he hit. does this seam right to anyone? This is yet another reason to kick them back to Mexico!

  1. The deductible applies any time you use your collision coverage. It does NOT matter who is at-fault. All that matters is that you use the coverage. Period.

    Now if you use the collision coverage your company will try to get that money back for you through a process called subrogation. Your company will try to get reimbursement from the vehicle owner and/or the driver.

    If the other driver was using the car with permission AND the owner has insurance that insurance MAY cover your damages. So if you haven't already done so find out what company insures the car that hit you. Then see if they will handle your claim. If they will, they should do it without a deductible and also provide you with a rental car while yours in the shop.

  3. How do you know he was illegal alien?  Even if he was, if it was his car, he has left it and the police can track him.  Your insurance can sue him for the deductible, and seize his car against it.

    But you have to pay your deductible no matter who hits you if it cannot be collected from somebody else.

    I suggest, since he was willing to abandon his car, he was a common car thief, in which case race, country of origin, language, gender, sexual preference, religion, etc, are all irrelevant, and you would still be stuck with the deductible.

    Sorry, that's the way it is.  You agree to your deductible when you buy your policy, and it is clear the deductible is your share of any claim made that cannot be recovered from another entity.


  4. First of all you don't know if the guy was illegal or not. Just because he spoke broken english doesn't mean he is illegal. If (like you stated), the owner of the vehicle showed up you should have gotten his / her insurance information and the name and address of his friend (the driver). If you had gotten the information, or if you have it, the owner of the other vehicle could be taken to small claims court and you would be able to get your money back.
