Ok, why do you think that the defendants attorney told me that he is ready to settle as long as I have a good attorney. He also told me that he would tell his clients that the best he could do is to sette. Why?

  1.      be careful.there is not a lawyer living that can be trusted.there are no good lawyers.so i dont know what he means by that.if they are ready to settle.what is the offer.your hearing is good.you dont need a lawyer to hear an offer.he already told you he is a lier.he wants to tell his clients you want to settle.and your lawyer is to tell you they want to settle.and you are supposed to think this is your best option.and his people to think it is there best option.after its all over.both of you get screwed by there fee.and in reality they did nothing.if you feel that your case is strong.you are in control.go to a lawyer.present yor case to him and they want to settle.and how much his fee is going to be.dont let him tell you he has to look into it.they want to settle.you like the offer.its settled.they push some papers back and forth.and its over.now if he tells you the case is worth more than they are offering.then you can make a deal with him that he gets a portion over the originl offer.do not sign any thing until you are happy with your decision.put it in writing.no hidden costs.in fact, you can even ask that they(the defendant)pay your legal fee.dont be affraid to check out more than one lawyer.choose the one that you like.good luck.i caution you again.dont sign any thing until an agreement is made between both of you.dont be intimidated by them.because you deserve the settlment.not the lawyers.

  2. Possibly because he is in fact ready to settle.  A trial is a crapshoot, for both sides, no matter how good the case is.  Every reasonable lawyer prefers the certainty of a result.

  3. Because YOU have a better case than HE does- & he (the Defendant) want's to "get out from under"- before the case goes to Trial & he Loses!!! DON'T fall for it if this Case is Important to You... Trials ARE a hassle- but they're NOT worth "settling for..."  :0

  4. I wouldn't believe him.

If he's ready to settle, tell him to make an offer.

If he doesn't make the offer, he's lying.

  5. First of all, if you have an attorney, it is against the code of ANY state for the defendant's attorney to be communicating directly with you.

If you do not have an attorney, you should probably consider getting one if there is reasonable money involved in order to help with negotiations.

The other attorney does not want the case to go to trial because he will loose, thus wasting his time and the court's.

Please don't listen to the people that are telling you it's better to go to trial. I have worked in the legal field for 16 years, and have seen enough cases to tell you that jurors and judges are GREEDY people. When awarding damages, they imagine that money is coming out of THEIR pockets. It's always better to just settle unless you've got some super-duper case at hand ;)
