Why does Texas not recognize legal separation? There are many people who are not going to divorce but may need to only separate because of religious or medical reasons. So many states recognize separation...why would only a few not?

  1. Most states do not.  Texas is a community property state and one is either married or not.  There is no in-between.  Ambiuities would make it difficult to do business.  If you went to buy or sell anything, no one could tell if the spouse needed to be involved or not.  A creditor could not tell if the spouse was liable and a buyer could not know if he had good title.  You are free to live apart, as many people do, and thousands of military people do, but the legal relationship is unchanged by the living arrangements.

  2. If u are going to be separated forever y not get a divorce?
