Question:

Why does cell phone insurance take my old cell phone? I paid for it... they shouldn't get to keep it... right?

I recently bought a new cell phone from t mobile, my dog chewed on it, I have insurance, so I was willing to pay the $50 deductible, but I dont understand why they make me give them my old phone, that doesnt seem right, I own the old phone, so I dont think this is legal.

  1. They paid you for the phone so it's theirs. It's the same way with cars. If you total it out and they pay for it it's theirs.


  2. when that insurance was handed out, they now own the phone, do you really want to keep a chewed up broken phone?? i mean what use would you have for it anyways??

    did they provide you a new phone?? if so they exchanged it for a phone that works you try and take that too court they will laugh at you and even maybe let u win by taking back the new phone and giving you back your old chewed up phone and thats it.

  3. You asked them to replace it right?  They gave you a new one, right?  That makes the old one theirs.

  5. Because once you put the claim in, the insurance company is actually buying the old, damaged phone from you.  

    Just like if you have a car, and total it - once the insurance company pays for it, it's theirs.  You get the NEW one, INSTEAD.
