my husband past away last year on Aug 5th and his death was ruled and accident. I filed my claim and everything bills are piling up and I don't know what to do. I could sure use the money. I call and every time they say they are still waiting on paper work his medical papers. One guy even told me that it looks like that my claim may be be denied, and I am like why his death was ruled an accident. Can they do that. Or what

  1. You need to call, raise H*ll and keep asking for the next supervisor and let them know your next call will be to a lawyer.

You should also call your states department of insurance and ask how they can help and file a complaint.

  2. There are some provisions to fill up in accident case.I don''t know which insurance company is making delay if every thing is o.k.

  3. I am not sure about alcohol exclusion and certainly if it is excluded somehow then they would need proof that it was the cause of death.

Furthermore an accidental death policy is frequently issued on a gauranteed issue basis with no underwritng questions, frequently part of a company benifits schedule.

if the benifit is substantial you would be wise to find an attorney that would take the case on a percentage basis.

  4. I went back and looked at your other question concerning your husband's death.  It involved alcohol and an insurance company can deny accidental benefits if alcohol was involved.  You should have someone at the insurance company tell you what they are waiting for and help them get it, but I would say based on how you say he died, that it will not pay.

  5. If the policy is less than two years old, and there was a misrepresentation on the application (either an "I forgot I was a smoker" or a flat out lie about a medical condition) then yes, they can deny the claim.
