Why does my boyfriend have to reapply for citizenship?

He was married before and applied while still married. He recently got a divorce. He called the place up where he was to apply for citizenship and they told him there was no problem. They sent him his questions to study. He went to take the test today and the woman said he had to reapply because he got a divorce and would need to pay once again the $665. I think thats so unfair. Can anyone help with this?

  1. He only got a visa and ultimately a green card due to his marriage.  Once the marriage was over, he no longer had any right to citizenship through marriage.  He's lucky his green card was not revoked since he really no longer has any justification for being here under "family reunification - marriage".  

    Any marriage which ends "prematurely" can trigger a marriage fraud investigation. Marriage is intended to be a permanent relationship and if it isn't, then marriage solely for the purpose of getting a green card is suspected.  Even naturalized citizenship can be revoked if a divorce takes place within 2 years after naturalization.  Being allowed to keep his green card is more than fair, and more than he has any legal right to.


  2. Rules are rules.  They had him down as being married and he is divorced, so must re-do everything.  This all costs money and should come out of his pocket.

  3. He applied as a spouse of a USC.  He is not one anymore, so he can't use that classification.

    Maybe you should talk to his ex-wife.

    My guess is that you are being used.

  5. And I wonder if he is going to try to con you out of the money and talk you into marrying him too.... hmmm  That's just the way it is.
