Why does my toilet always back up and smell bad?

I just bought a brand new condominium, it was finished being built in November 2007. We are on the 3rd floor and our master bath toilet always clogs. It smells horrible all the time, even after I've just cleaned it and I need to clean it 3 times a week or the smell is just horrendous and stinks up my entire bedroom. I've asked other people in our building if they've had the same problem. They have clogs every once in a while, but ours is a daily thing. It clogs even when we pee. What is wrong? And why does it always smell?

  3. Even without a vent pipe there should be no odor, as the water in the bowl acts as a vapor barrier. As to why it would smell all the time, no clue. But obviously there is an obstruction somewhere if you have to  plunge pee.

    I agree with the poster who says to contact the builder about your warranty. It should cover this as long as you didnt flush something huge down it.


  4. Get the Health  Department in as something is wrong. They will make the Builders come back and rectify it, as it is their problem being new. Nearly all new Buildings have a warranty for so many years, and you should ask for one off the people who sold it to you.This is a health hazard and I am sure your Health Dept. will agree with you, so you should have nothing to pay. It is not your fault. !!

  5. One possibility is that when the toilet was set, the wax ring was partially blocking the drain.  The plumber who piped the house should be brought in to pull the toilet, just to verify that it was installed properly.  If that still doesn't help, a plumber with a camera might have to be called in to inspect the interior of the piping to ensure that construction debris is not lodged in the pipe.  A vent problem, would just make the water start to flush, fill up the bowl, and then the water would recede slowly over an extended period of time.  I don't think it is a vent problem.  Good luck!
