It depends on what context you watch it.  If you are law enforcement, or an attorney, or a member of a jury, you may be forced to watch it so you can determine what value it has as evidence.  If you watch it in a sick pornographic context, then that is illegal.

That's the same as asking why everyone who watches ANY type of child p**n hasn't gone to jail. I think another good question about this could be: why isn't R Kelly in prison for that s*x tape he made with that 15 year old girl?
