Why don't we cite cell phone users for loitering?

If I stand around on the corner or near a building just getting fresh air, I'm told to "move along" by the cops. However, if I'm yakking on a cellphone, I can stand there all day.

  1. I guess people consider it more polite to do your "yakking" outside as opposed to doing it in an enclosed space with a bunch of other people. They might be assuming that you were going to go back inside whenever you were done with your phone call. That's the only thing I can really think of.


  2. Would you rather these yakkers be in thier CARS, driving while distracted? I prefer them loitering, not harming anyone than anything else.

    Besides, since when can cops get after you for loitering and getting fresh air? For all they know, you could be waiting for someone.
