It seems like they have pretty good evidence against her, but they have charged her w/ several other things. How come?

  1. They don't have enough evidence to indict her...having suspcious behavior is not enough. They don't have a body, they don't have a motive, they don't even know if she is dead or alive for sure, and if they did know that she is dead they don't know how she died.

The case would be way to circumstantial ...too risky.

  2. Well, the burden for establishing probable cause to arrest or indict is pretty low, but have no body yet!  It is a good thing that she does not live in Middlesex County, Mass. because she would have already been indicted!

  3. They have charged her with what they can.  They don't, according to the media, have conclusive proof that her daughter is dead.  They have not stated that the dna evidence on the air from her car can be linked with a specific person who is decaying - they just said that it is conclusive that it comes from a decaying human.  They can't charge her yet until they get to the bottom of how that 'air' got in her car and who it is from.

  4. Because there's not enough to arrest her with.
