why is it when you go to your first appearance the next morning after being arrested and you do not get bond...why do they wait 5 weeks for the dockett sounding? my boyfriend violated his probation(habitually driving while license suspended) had a warrant out for violating, he turned himself in to his probation officer and he got arrested. do you think he will get released(at his court date in 5 weeks) at that time for time served?

  1. Maybe, maybe not. It's up the Judge.

Scheduling a Court hearing is like anything else that is scheduled. The next available time/date is selected.

  2. He should be eligible to be OR'd, where he's released on his own as long as he doesn't have any FTA's (failure to appear). You might want to call his probation officer because typically the courts listen to what the probation officers have to say.
