Why is it important to have an independent judiciary..??

  1. Because they are supposed to judge cases based on teh law as written.  If they become political, then they will judge based on politics and political beliefs.

    Many of us believe this is one of the major problems with the Supreme court.  Too many justices rules based on what they believe rather than ruling on the law as it is written.  If you  don't like the law, get new lawmakers.  (Congress)

    The judiciary should NOT make law.  That would negate a democracy and move a nation toward an oligarchy.


  2. Theoretically, it allows the justices to promote justice as opposed to participating in partisan bickering. In reality though, this is impossible to achieve as long as humans are involved.

  3. If it is independent then there will probably be less problems when a person of high governmental authority is caught doing something. If it was owned by the government they would likely want them to get out with very few consequences. This is the same idea for a major business. If a business owned the judicial system then they may use large sentences to rule with an iron fist and possibly gain money through bribary etc. The jails would fill up extremely quickly too and then there would be the problem of overcrowding in jails and also mass murderers on the streets.
