Why is it so hard for a biological father to get custody?

A friend of mine hasn't seen his 2 little daughters since 2006, partly because their mother lives 200 km from here (in the neighboring country). They were never married. Why is it such a year-long struggle with lawyers and justice?

  1.   Because judges tend to side w/ mothers.  Even if they are little wh-res who spend all their time out partying and live off their kids' child support.

B/c the judge takes into consideration, who has the kids, who takes care of the kids on a day to day basis, they look at the kids' well being, if their's abuse involved, or anything that would cause harm to the kids, and they have to decide with all the evidences etc, on who gets custody of the kids!

  3. because the jury tends to sympathize with the mother more.  especially if the father has a drug or alcohol problem.

It is very hard and unusual for a father to have custody of his children, because the court always leans towards the mother as having the maternal instinct.  You didn't say there is anything wrong with the way she is raising them.  What has the court said about his right to visit them or have custody on weekends?  Is he paying child support?  Even without paying support, every parent has the right to see their children, so he should hire a layer to make visitation agreements final.  good luck.
