Question:

Why is it that those who use the constitution to prove their point are the ones that do not understand it?

i have noticed that lots of people try and use the constitution in their attempts to win an argument. but these are the same people that do not understand it...they dont know what certain parts are applied to and what not...these are the same people that twist and turn the constitution and these are the same type of people who are hypocrites....they talk about their free speech and what not but then someone else comes along and because they dont like what they have to say, those people want to get them in trouble.

are these people that are abusing the constitution this way just making a mockery of it and just pushing for some kind of reform?

why dont the people that use the constitution to win an argument actually do their research, are they afraid that if they did they would end up being proven wrong?

have you been around people like that? (i also find that there are ALOT of people like that on yahoo answers too).

  1. Can you provide an example?  Its an interesting question but light on specifics.   And if you ever studied Constitutional Law you will see instances where new landmark cases actually alter or completly strike down previously accepted laws.

    I am thinking how the legislation coming out of the Dred Scott case as well as Plessy V Fergusson are no longer the laws of the land.  


  2. I'm not sure what direction you are taking this, but in general, I agree.

    I have read statements and reactions to statements on this site that strongly underscore your objections.

    From BOTH sides of the issues.

    Our founders gave us a Constitution geared to assure individual freedom and liberty.

    Along with those rights comes responsibility. We, as individuals must police ourselves and never use our freedom and rights to suppress those of another. If that aspect of the Constitution were applied, slavery would never have been permitted in the USA, but then, the Constitution has never been followed. When we refuse, as a society to hold others responsible when they misuse their freedoms, we encourage the degradation of our Constitution and our society.

    Power of governing was deliberately placed in the hands of the people to prevent tyranny. Our founders understood that power corrupts, so if the power is widely disbursed, then no one group could garner enough power to become tyrants.

    Money is power, so giving up the responsibility of self-reliance and demanding the government furnish all you need for your welfare is asking them to take your money and your power and use it as they see fit. That guarantees tyranny by giving them too much power over your life.
