a husband has rights over his wife's body and similarly a woman has rights over her husband's!

sometimes wives deny s*x to their husbands to blackmail them forcing them to take this step

its better to rape ur wife than to visit a prostitute or have extra marital s*x

if a woman dutifully fulfills her responsibilites, such a situation wont arise where a husband has to force himself on her

i feel marital rape shouldnt be reagraded as a crime, and the courts should see the reason y the husband was induced into taking this drastic step!

I'm really amazed to read so many answers here few given by practicing advocates from India & no one even telling you what is the actual meaning of Rape as provided under section 375 of the Indian Penal Code which states: - Rape.

A man is said to commit "rape" who, except in the case hereinafter excepted, has sexual intercourse with a woman under circumstances falling under any of the six following descriptions: -

First: - Against her will.

Secondly: -without her consent.

Thirdly: - With her consent, when her consent has been obtained by putting her or any person in whom she is interested in fear of death or of hurt.

Fourthly: -With her consent, when the man knows that he is not her husband, and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.

Fifthly: - With her consent, when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by him personally or through another of any stupefying or unwholesome substance, she is unable to understand the nature and consequences of that to which she gives consent.

Sixthly: - With or without her consent, when she is under sixteen years of age.

Explanation: - Penetration is sufficient to constitute the sexual intercourse necessary to the offence of rape.

Exception: -Sexual intercourse by a man with his wife, the wife not being under fifteen years of age, is not rape.

If you have gone through this definition of Rape then you must have even read the Exception given in the end, wherein clearly it has been given sexual intercourse by a man with his wife who is more then 15years of age is not a rape. So where you read that in India if a man does forcible s*x with his wife who is of more then 15years of age is committing Rape?  The marital rape is only possible if husband & wife are living separately from each other under a decree of separation or under any custom or usage as provided under section 376A of the Indian Penal Code :- Intercourse by a man with his wife during separation.

Whoever has sexual intercourse with his wife, who is living separately from him under a decree of separation or under any custom or usage without her consent, shall be punished with imprisonment of either description for a term which may extend to two years and shall also be liable to fine.

So in normal circumstances when both husband & wife live together under the same roof & the husband commits sexual intercourse with his wife even without her consent then even this clause of punishment for marital rape will not be of any avail, unless the couple was living separately under a decree of separation or under any custom or usage. ‘Decree’ here means one which has been issued by a court of competent jurisdiction. This is a technical point which a lawyer/advocate should have taken note & explained it to you.

It shows the utmost level of  individual freedom. Eventhough they are wife and husband, their natural right of individual freedom is not surrendered to any one. Criminal law of each country gives this right.

Rape of a wife is not as serious as the rape of other kinds. If the wife is not in a mood to have s*x due to emotional or physical reasons but the husband is interested in having the s*x, then comes the clash.
