  2. Because the pull of the sun's gravity is stronger.

  3. Both Mars and Jupiter are in orbit around the sun.  The orbit of Mars (and the earth, and the rest) is affected by the gravity of Jupiter, but not enough to stop either planet continuing in a solar orbit, as the influence of the gravity of the sun is much greater than that of Jupiter.
