Why is there no punishment for filing false rape,molestation or sexual harrassement charges ?

What does letting a misuse of the laws go scott free send as a message ?

How does the law justify the suffering of victims of misuse of these laws by saying that ther are these crimes are on a large scale and so the the lesser number of victims of misuse should be ignored?

In a domestic quarrel if a woman calls up the cops the guy gets hauled no questions asked does the same happen to women if the guy calls up the cops?

Does a woman lose her job if a man files for sexual harrassement just like a man would lose his job if a woman does?

There are laws against filing a false report, but proving that is similar to proving perjury.  It is often one person's interpretation against another's.  The Duke University Lacrosse team incident is one where the signals were clear from the beginning, but for whatever reasons the D.A. decided to ignore them.

    But there can be consequences.


  2. Excellent question. Answer:  my ex-wife was caught in perjury by three different judges.  Not one ever punished her.  Once my newly ex-wife called up my boss to yell at him.  I got fired a few days later.  The boss didn't want to garnish my checks for child support.  This does happen folks.

Ok here it is, once the authorities are called out on a domestic disturbance they evaluate the seen, take statements from both parties and compare it to the call out info. form this point they have to conclude who is the aggressor and then make a arrest and yes by law they have to come to this conclusion regardless of what they may fill. they then figure out what level of infraction has been made and place a charge on the salient. this charge is then arraigned and the DA takes the case and from this point the perp is usually let go on his or her own trust and the DA either drops the case or Perseus it and a herring is set if challenged.

  7. There are charges that are laid in this case.  You need to explore the criminal justice pages of the particular country rather than listen to the rantings of a few undeducated, jaded, angry males who really know very little of what goes on other than in their own dreary little basements.

Q#1: There are punishments, if it can be proven.  Slander- you can't make false statements about someone without the facts to back it up, if damage is done to the persons reputation, business, employment it can also be taken to Civil Court (USA).  Perjury as another answerer stated, if the case has been in court and it can be proven that the victim lied about the rape,harassment, etc.,.

    Q#2: Many times rape, harassment and molestation cases go unpunished as they are hard to prove.  Therefore the victim suffers without seeing justice prevail.

    Q#4: If the woman is the obvious weaker person in the domestic dispute, yes, usually they side with her.  If they show up and the woman is built like a line-backer, they would be a little more likely to hear more of the story and determine that she was perhaps the abusive one. Think this one is based on perception of what is seen by the officers when they arrive at the scene of a domestic dispute.  Where I am from, they have to take one of the parties to jail on a domestic call, most of the time, yes it is the male.

    Q#5: Yes, it's been done many times. It's not as common, for several reasons, not as many women have that kind of power over a man in the work place, men aren't as offended by sexual jokes, flirtations, etc,.

    It sounds as though you are close to a case gone bad for lack of evidence either way.  It goes to show that you can never be too careful who you're dealing with, and to always be leary and cover yourself in any / all situations.

  11. In the US there is a punishment -called perjury-for filing false charges for crimes-regardless of the crime and regardless of the gender of the accuser or the victim.

    It is illegal to file a false police report of any kind. There are not laws specific to false rape accusations for the following reason.

    Rape, while a very serious crime, has a tendency, at least up until recent times, to be difficult to prove. Even today, evidence of a rape may not be distinguishable from consensual s*x, depending on the circumstances.

    The law does not want to incarcerate innocent people. Though there are most certainly men who have been falsely accused and imprisoned for rape (usually due to cases of mistaken identity and not the fact that a crime hasn't been commited), it is far more likely for a man to rape than a woman to claim to be raped, and not being able to prove a particular man raped a particular woman does not mean she was not raped.

    It is a matter of which situation is more likely to happen. Now if it can be proved without a doubt that the woman intentionally lied about being raped, of course she should be punished.

  13. Firstly because rape / consent can be such an uncertain area (his word against hers) it can be impossible to tell whether a rape has occurred. (<6% conviction rate.) Therefore it is equally impossible to tell if a rape hasn't occurred. So even if a defendent is acquitted that is not proof that a woman has lied. It just means there is no evidence to prove the defendent is guilty.

    Falsely accusing someone of rape is certainly a crime.

    A woman certainly may lose her job if she files sexual harassment charges. Many women don't bother to report it for this reason.
