Why is this offense already on my record???

I am currently in the process of taking a charge through the criminal justice system...I am a month away from the pre trial meeting...but already this offense is showing up on background checks???

How can it show up if i have not been convicted?? is this legal??

ive been charged but not convicted....

The arrest is a matter of record.  An arrest has no legal significance but if some private employer draws some inference from an arrest without conviction, there is not much you can do about it.  Even if you are acquitted, the fact of the arrest will remain on the books as an accurate record of police activity.

  3. A criminal record will show charges and convictions. If you look at the details, you will see an entry indicating there has not been a conviction entered.

    Arrests are a matter of public record, so yes, it is legal.
