Fruits and Vegetables is a pretty arbitrary category in common usage, but in botany is quite specific.  Anything that grow from the ovary of a fertilized flower is a fruit.  This includes tomatoes, squash, green beans, peppers, eggplant, apples, cucumbers, pumpkins, etc...

Botanically it is a fruit because it bears seeds.  Any part of a plant that bears a seed is considered the fruit of the plant.

Some lawmakers in Congress decided they wanted to tax it differently, so they consider it a vegetable for those calculations.  However, they're all a bunch of idiots, and they wouldn't know an angiosperm from an endoscopy.  So forget you ever heard that, if you ever run for congress, make your platform "Let's fix this tomato issue once and for all, you bunch of rubes."

A tomato is a ovary that has increased in size and contains seeds so it is a fruit.

Since the tomato is both the fruiting body of the tomato plant as well as the reproductive system for it, it is calssified as a fruit. At least that's how I think it goes.
