Why they mix religion with law in Malaysia?

Like in Saiful's case. Law is law, religion is religion, why they can mix religion with law?

If I commit an offence, then I just tell lies in front of the holy book then I can get away with jail term?

    of coz la i respect the "ketuanan melayu"...

    but thats totally different... how come race issue also in politic?

    just look what happen to Obama... Clinton lost coz not only the black vote for him...

    that tell us a message that race have nothing to do with politic...

    now i understand why some eligible voters dont want to come out to vote...


  2. Be cool la bro ... don't become judgmental ... prejudice or mental block ... what you see right now is a sample of failure of administration especially on Article 121A of the Federal Constitution.

    Actually Law, Religion and Morality are connecting to each other for example ... if you commit murder ... it is against the law and religion and partly morality. You need to understand the law in Islam and the Syaria Law of Malaysia ...

    Syaria law in Malaysia is authorized under state legislation and article 121A ... and most of the law are "takzir" which mean by interpretation.

    Islamic Law in real based on Quran, Hadith, Ijma', Qias, some form by Adat ... following the concept of Fiqh. It's not limited to that ... there are various interpreation of Islamic law and it may include the Sufism or any other teological school of thought.

    in Islamic law, a person who is accused by another ... the accuser must swear by the name of Allah ... not holy book ... to affirm that his allegation is true and yet for the offence of sodomy he must bring foward at least 4 male witnesses (with some qualification under Islamic law). Failure to bring those witnesses may render the guy punishable under the offence of QAZHAF. [the object of this provision is to ensure that every allegation must come with strong evidence - mere slander will not be entertain and may be punished]

    The effect of Swearing in Islamic law ... is not much different from the Civil or Common Law whereby each parties may have to swear before the Commissioner for Oath under the Statutory Declaration or Affidavit ... or Swear before a judge in court.

    No one can escape imprisonment merely by swearing ... there are procedures that you have to follow either under Syariah or Civil Criminal law in Malaysia. Therefore ... you don't get confuse on the current case because Anwar filed a different suit in Syariah for different matter by different procedure and yet till today there is no charge on Anwar in Civil court so he is free to do so.

  4. i'm not a lawyer and of course not law student background..

    1st Malaysia is multiple race/religion/cultural..it difficult to be scynronize..different people different opinion/believe n etc..

    2nd Law in Malaysian still need improvement

    3rd  Some people use law to bound theirself without proper channel

    If you break thre law, religion helps you to get away with it scot free...

    If you fall foul of religion, the law can overrule...

    Law is law and religion is religion.  BINGO!!

    But people out there are making use of the religion to gain supports for whatever reasons. I am not talking only about Saiful's case, there are many cases which were highlighted in the news too.

    Religion is something that teaches us good and these people who uses the power of religion thinks that they are intelligent enough to get such attention of their 'own' people to side themselves.

    I have always believe in the before and after effect. You might use religion to get over a situation, but don't treat god (whatever religion it may be) like a bloody fool. He/She knows what you have done. And comically, if the god decides to take a 'salary' or 'commission' from you for using his/her power, you might end up with deeper trouble.

  9. Well there you go, this is Malaysia. You can see something more absurd than this I am sure.

    Oh no, if you meant swearing in faith in bible, this is how it is in other countries. Non-christians do not swear on bible, they affirm or make oath. Regardless of what religion, you do it. I am not sure about Muslims though.
