Why won't my Mom pay off a credit car she put under my name?

Without my permission, she put a credit card in my name and went over the limit. They wrote it as a charge off. It is 967.00. How do I get rid of the charge off? It's causing so many problems. We start getting in fights because of it. I can't get any loans to move because of it. She also put all the utilities here under my name because her credit made her put a deposit down. Why am I being punished. What legally, could I do?

  1. If you did not sign the credit application this is not your debt.  WRITE to the card issuer and inform them that you did not apply for this card and deny responsibility for it (Certified mail, return receipt).  Same with the utilities.  Send copied to the three credit bureaus. They will not "write off" the debt, however.  They will try to collect from your mother.  They may also report her to the police and have her charged with fraud.


  2. What your mom did is illegal. If you really want to pursue this, you could sue her for fraud and theft. Your first step would be to talk to a lawyer.

  3. Well, it looks like your mother is going to refuse to pay it off no matter what you do. The only thing I can tell you is to talk to the credit card company itself and explain the situation. You never asked her for the credit card, she put it under you name, maxed it out, and is refusing to pay. It's causing you problems. Talk to the credit card company and explain the situation. They might be able to remove the charges. However, based on the situation, legal actions could be taken against your mother. She is using a credit that technically doesn't belong to her and refuses to pay.

  4. Are you 18 yet?  If you are, you shouls start disputing all these debts through the credit bureaus.

    Once she is convicted then you inform all the relevant companies that the defaults need to be transferred to her - and they will clean up your report.

Legally you can really get her into trouble for using your name.  You should go to the credit reporting agencies and file a dispute for the charge as well as putting a Fraud Alert on your name/etc so if someone DOES try to do this (your mom, whoever) there will be a red flag if she tries to do anything in your name.

You aren't being punished, you're being used.  My sister did the same thing to her two daughters and ruined their credit before they were even old enough to establish it for themselves.  You can try to fix it when you are living out on your own.  If you are 18 you can sit down with a lawyer and ask what your options are...their first consultation is free. I'm really sorry that you are a victim of your mother's credit scams. This should not be legal for a parent to do this, but unfortunately it happens all the time.

    BTW...she will not pay off the credit card that's in your name as it does not affect her credit, it affects yours.
