Why would a national car insurance company let their insured tell them what to pay on claims?

We had a young lady run into our truck. Her insurance company is not covering the damage* at her request * to our truck .So we have a 1000.00 repair bill . What should we do?

  1. An insured can refuse to have a claim made on her policy. Most insurance companies will encourage their insured to agree if they know she's at fault. If she's at fault and they know it, and don't pay, then when you sue her, it's more paperwork and hassle for them.

    I'm sorry you have to deal with this, but you're probably going to have to take her to small claims court, or you can call your own insurance company. You'll have to pay your deductible (but hopefully it's less than $1,000). Then, after your insurance company gets their money back, they will refund your deductible to you. If you don't have full coverage, then your insurance company many not help since they don't have an interest in the car. It's silly the girl won't let her insurance take care of it b/c she's now going to be responsible for things the insurance company won't pay! (Court costs, lost wages for you taking time off work.)

  3. Sounds like she is not admitting guilt.

    Her agent is only protecting their client - and the client is saying "it was HIS fault!"... our job is to believe your insured unless you prove her a liar

    You need to prove she's guilty - you get a police report?

    It's extremely unusual, but not impossible, for a commercial auto policy to have an endorsement on it that allows the INSURED to give a "yeah" or "nay" on the company paying the claim.  If they say no don't pay it, though, the insurance company is "off the hook" for any future payments.

  5. call your insurance company and report the accident.  they will fight the other company for you.  They will also tell you what you should do next.

    what company does she have.  that's not right that she can say 'oh don't cover that accident'  if she is at fault, then she has to pay!
