Why would a person not be put in jail untill his sentenceing hearing when he was charged with having drugs

a man was charged with having drugs in his car, he went to court and the states attorney has said he will plead guilty at the sentance hearing and then go to prison, but why is he not in jail right now ?

  1. because he went to first appearance and bonded out then months later he went to the sentencing hearing they do not keep you n jail until your hearing unless you either cant bond out or you commit a capital crime

Because he has not been proved guilty yet (in the legal system you are Innocent until proved guilty) and until the judge says he is guilty then he is classed as innocent, it does not matter what anybody else thinks its the way the law is. He was set free because he could have posted bail or his lawyer could have fought that he was not a threat to society and was not a threat to skip his court date and do a runner.

  3. your innocent till proven guilty and even then there is a thing called posting bail
