Wife's Conditional Status VISA?

My Philippines born wife has been in the United States for over a year. We have to file for the removal of her conditional status from her VISA in June. I just received orders to Korea, which is an unaccompanied tour, and our follow-on is to Japan. What can we do to keep her from losing her VISA. I don't want to have to wait 6 months for her VISA to be issued again, not to mention have to pay for it again. We have contacted the USCIS several times, but get conflicting answers.   1. File the I-751, application to remove conditions. Include all supporting documentation and filing fees. Add a copy of your Military Orders and a cover letter explaining your situation.

    I have had similar situations with military wives, where wives reside abroad, file the I-751 in the USA, and have the conditions removed.

    Also, keep in mind that as a wife of a US Army member, your wife is in a special status, and can later apply for naturalization/citizenship even if resides abroad (Japan, Korea). Good luck!


  2. Is your wife on your orders for the follow-on tour in Japan?  If not you need an ORDMOD to include her.  Understand?  She's got to be on the orders as a command sponsored dependent in Japan.

    File the I-751 along with a copy of the orders now.  If she's going to wait in the Philippines while you're in Korea she'll need to file an I-131 BEFORE leaving the United States.

    When it's time for you to transfer to Japan you'll have to arrange her transportation through your personnel office in Korea.  When she gets to Japan your personnel office there will get a SOFA stamp for her Philippine passport.
