Question:

Wife did not re-finance house per Divorce Decree, how do I get removed from being listed on credit report?

Divorced in December of 2006. Divorce Decree states that the wife takes the house and has 90 days to refinance it in her name solely. When we bought the house, we did 100% financing in an 80/20 loan. She refinanced the 80% loan and I signed a quit claim deed to remove myself from the title. Then everything went downhill.

She quit her job and moved out of state. She then rented the house out. The lender got wind of what was going on and did not allow her to re-finance the remaining HELOC 20% loan without a bunch of $$$ up front. So a year and a half later, I'm having trouble securing credit based on this being on my credit still (not to mention I'm still technically liable if she defaults). Ex has since re-married and has a child. Lives out of state and still rents out the house. She does not reply to emails or phone calls. What can I do? Lawyers have not been helpful as of yet, neither has the company who owns the loan.

  1. The only bad thing about a divorce decree is the only thing they are good for is dragging your ex back to court if they violate it.

    Lenders are not bound by them and since she has moved out of State this may be a problem having her extradited back to even go to court.

    I wish you luck it sounds like your going to need it.


  2. Do you have a copy of the divorce decree? Goand doit

    yourself.  I sort of hard a similar situation, but since my ex didnt really want to deal with it or just didnt want to

    pay, since the house isstill in your name, its still considered your home,  so

    call themortgage co. and refinance, you will pay but at least

    youget your name taken off.

  3. Dude, if she violated the Decree, take her to Court.
