Will I get a ban??

Right OK.... I dont need lectures I know its my own fault and I am stupid.

Yesterday I was caught doing 99 on a 70mph motorway.

I am in my first two years of driving and already have 3 points!

I have to go to court......will I get just get my license taken off me or will I get a ban. if it's a ban how long will it be for????

  2. The offence attracts 3 - 6 points plus a hefty fine. As you already have 3 points, you're going to broach the 6 point limit for new drivers, and will be going right back to provisional status until you retake & pass your test again.  That will include L plates, accompanying driver, no motorways etc . . .

  3. they might ban you, you will def get more points and hopefully a huge fine to pay , and possibly made to retake your test.

  4. Having your licence taken off you IS getting a ban.

    You can expect to be getting the bus for anything from a month to a year. Also expect to be giving over your next four to ten wage packets so this glorious government can dish the money out to third world countries more freely.

  6. You will get another 3 points on your license taking you to 6, which I believe means you may well lose your license. How long for I'm not sure, and there is every chance you will have to resit your tests-both theory and practical. You may get lucky, but don't bank on it.

  8. All the legal facts seem to have been covered here. BUT - if your car is essential toyour job and you can prove it will cause hardship for someone other than yourself (if you are a carer for example or if you employ other people and losing the licence means losing the business) then you can claim mitigation. I got caught (no lectures please) doing 104 in a 60 zone. Not big or clever i know. I hired a barrister to fight my case and kept my licence! Best £1200 I ever spent. Plus the £400 fine and six points means I am now very careful. Expensive lesson but one actually learned. Most motoring lawyers will give you a free consult and give you an idea of your chances of success before you cough up the t1000 plus pounds it'll cost. Here's the ones i used. Good luck.

  9. Couple of questions for you: -

    1) Were the 3 points you currently have on your provisional or full licence? It doesn't normally make any odds, but you never know.

    2) How long ago was the 1st offence - and what was it for?

    Speeding on the motorway usually results in an automatic ban *if you were doing over 100mph*. However, you appear to have just sneaked in under that, so you may get away with it. *HOWEVER*, if your 1st offence was also a speeding offence, and it occurred within the last 5 years (points are considered 'spent' after 5 years), then this will be taken into consideration.

    The law states 'discretionary disqualification'. So, if your previous offence was also for speeding, then you may very well be disqualified.

    You will certainly receive a Level 4 fine (£2,500) and between 3 and 6 points (as you were pushing 100, 6 is the most likely outcome). Reach 12 points within 3 years and you are automatically banned (and the 3 years means the dates of the offences *NOT* the dates of the hearings) for a minimum period of 6 months.

    Two speeding offences (especially if they were both well in excess of the limit, or one was in a built up area which could have resulted in loss of life) would certainly be grounds for 'discretionary disqualification'.

    Personally, I reckon you're looking at a £2,500 fine and 6 points.

  11. If at court you get three or more points on your licence then your licence will be revoked by DVLA meaning that you will have to retake both parts of your test. The court may also at it's own discretion ban you from driving for a period (typicaly 6 to 12 months) if that is the case you will not be able to start the retests until that ban has finished.

  12. YES! That is the only answer to this question.

    You will get a ban, 3-6 penalty points which will mean automatic ban. After the ban is up you will have to retake your driving test, including theory. The court might also tell you to take your extended driving test.... which is a bit stricter than an L test beginner.

    After passing, try getting insurance!!!! You will be hammered. You will probably pay double for your speeding.

    Finally, this bit about if you get your license taken off you, you think you can just get another licence. NO. THEY TAKE YOUR LICENCE OFF YOU, YOU WILL NOT GET ANOTHER. YOU WILL HAVE TO SIT OUT YOUR BAN THEN TRY ALL OVER AGAIN.
