Question:

Will I get evicted if I just got married but my spouse is ineligible to be put on my lease?

I just got married about 2 weeks ago and found out that my spouse has bad rental history. We are living together but my property manager said I must put him on the lease. If he gets declined (which I know he will because they are very strict on who gets in) will the property manager be able to evict me?

  1. If you live there already on your own, and qualified on your own, I don't think they will want you to leave just because your husband has poor credit.  But if he is replacing a roommate who had good credit, then they might see it as an increased risk and turn you down.

    So, if you already qualified on your own, its probably just a matter of telling them you got married and having his name added to the lease.  The lease will be joint and several, meaning you are both obligated for the full amount of rent, so they are no worse off with adding someone with weak credit.

    What I would expect them to care more about is his reference from a previous landlord, in terms of did he leave damages, was he a problem in other ways.  That is relevant to the landlord, more so than the credit issue if you qualify on your own.


  2. Yes, if you have him living there as an unauthorized tenant.  Try to do it the right way, if he gets denied then they should at least give you 30 days to find a new place to live.  Good luck!

  3. They can - but it is ultimately up to them.

    If it was just a roommate situation - they probably would deny him but they tend to be more lenient with married couples.

    All you can do is ask.
