Will I get my ex's stimulus check due to back child support?

How can I make sure I get my ex boyfriends stimulus payment? He owes me 20k in arrears. He is supposed to pay me 460 a month that's what the support is set at, but he's been paying me 260 a month for the last several years. Will the fact that he pays more than half mean that he gets to keep his stimulus check?

Have you filed a contempt charge against him or reported the fact that he is in arrears to the child support agency in your state?  If not, then you won't receive his stimulus payment.  You should make a call to the child support agency in your state and find out what you need to do to report the back due amount that he owes you.  They will review the child support amount and determine whether the monthly rate needs to be adjusted based on income, then will tack on a certain amount each month to make up for the past due amount.  Another benefit is that they will begin a wage garnishment if he has a proven history of not making the full payment.  The payment will be deducted from his pay before he sees it, so there won't be a choice but to pay the full amount.  They will also put in the paperwork (or help you to do it) that is necessary to ensure that you'll receive any IRS payments that are due to him until the back amount is paid in full.  Go ahead and give them a call... they'll steer you in the right direction.
