Will I get my last paycheck if my company files bankrupcty and closes it doors?

I work for a title company, and they have stated they have filed bankrupcty and are no longer in business. We did not get any pay. So are now in the hold 12 days of pay, just need to know if I will get this pay or if I will have to sue for it.

  1. Probably not, don't count on it.  If they are out of business, you are behind quite a few creditors--you are not a "secured creditor" so you are out of luck.  Hopefully you can get UI if they paid into the system!


  2. I think it depends on the type of bankruptcy--chapter 7, 13, etc.  You will probably be behind the IRS--sorry.  ey, check your retirement account if you have one with this co.

  3. You will probably have to sue.  If there are other employees in the same situation, you could all put together for a lawyer to represent the group.  It make it cheaper for everyone that way.   Same thing happened to my brother once, that's what they did.
