Will I have to pay back medical card?

I had back surgery a year ago and at the time I had a KY medicaid card. They paid for the surgery because workman's comp refused too. I no longer have the medical card becuase my income went up so i lost it. About a week ago i found out that i won my workman's comp case. The judge awarded compensation and medical, but my lawyer says that if i give up my medical he can get me enough money to pay off everything that i own except my house and still have quite a bit left over. my question is if I do this will medical card come back and want me to pay them back for the surgery? What are the chances of that happening?

I DONT THINK YOU WOULD HAVE TO PAY THEM BACK BUT THE INSURANCE COMPANY WOULD BE RESPONSIBLE FOR PAYING THEM AFTER ALL IT IS THEIR FAULT I REMEMBER IN THE YEAR OF 2002 I WAS IN THAT SAME SITUATION AND THE STATE PAID FOR MY SURGERY AND THE INSURANCE COMPANY PAID THEM BACK TALK TO YOUR LAWYER PLEASE DONT LET THEM GET AWAY WITH IT


  2. As an insurance broker, I would say your chances of having to pay this back are pretty good.  Since they only paid it b/c workers comp. refused and now workers comp. comes thru, you should pay it back.   I wouldn't count on them NOT finding out.

In my mind, if you "won" your case, the work comp carrier should be required to pay for any past medical expenses that were related to the case and should not be a consideration of what your monetary settlelment will be for future expenses. If you had health insurance that covered the back surgery and later got an award that the work comp carrier was obligated to pay for those services, it would be a matter of subrogation and the work comp carrier would be required to reimburse the health carrier for those services. Why should or would that change simply because the State paid for your services?
