Will I have to pay out of state tuition?

Okay I am a senior in high school. I live with my dad in Alabama. I want to go to school on New York where my mom lives. I go to NY every summer and stay for the whole summer. If I go to college in New York, will I have to pay out of state fees?

  1. Pretty clear that you live in Alabama the majority of the year.  Your dad's tax returns likely say that too.


  2. Go with the first answer you got here, and not the second. But let's put it this way - you'll be far, far better off if you actually intend to live with your mom when you attend school.

    Here's the actual New York State rule that applies in your situation:

    "Individuals who are financially dependent and whose custodial parent(s) lives in a state other than New York are generally not eligible for the resident tuition rate. However, students of divorced or legally separated parents may acquire a New York State domicile if the custodial parent is a New York State resident or if the student resides with a non-custodial parent who is a New York State resident and the student intends to continue to reside with that parent throughout their attendance at a New York State college or university"
