Will OBAMA stop trial lawyers from destroying our health care community? ?

Constantly, we hear every liberal and socialist leader (as if there is a difference) spouting and ranting about the high cost of health care.

Yet, the democratic party and their ideology has created the environment for ambulance chasing trial lawyers to besiege our health care industry. Liberals have caused the USA to be the only country in the world that doesn't follow the "English rule of law", where the loser of the law suit pays the costs and damage to the victorious party. So, trial lawyers advertise to poor people and desperate people to file frivolous law suits and ask for "lottery level" payouts.

The trial lawyer takes 30% - 40% of the booty. Guess who pays for this, of course its the consumer. That's why health professionals and groups have excessive charges for malpractice insurance and force people to have needless procedures, tests and operations.

Yet the group who complains the most about health care costs and the need to nationalize it are the same people who allow these cretins (trial lawyers) to wage war on the medical and drug community.

Liberals always blame corporations- drug companies and insurance companies- who act the way do because of the litigous environment, liberals have forced onto America.

No other country in the world has this insane policy but the USA; is it a surprise, only in America are the courts backed up, with tons of frivolous law suits?

Will Obama stop these trial lawyers from destroying our society or is his goal to nationalize health care, to move us closer to a completely socialistic society?

  1. No, the trial lawyers are needed. I think you dealing with the wrong end of the problem.  It isn't a case of liberals blaming the drug companies or health care system.  It is simply doctors that are making mistakes and causing harm to their patients, and drug companies rushing these pills out the door without completely testing the results.  There would be no claims to file against if there wasn't injury.  It isn't a frivolous law suit when you or your family are the victims of malpractice or faulty medication.

    There are plenty of cases where hospitals have mixed up the patients charts and medical histories, surgeons have left operating instruments inside people, and medical companies have sold medicines where they knew were risky.  People have a right to seek compensation for acts like these when they have suffered or experience loss in the civil courts.

    Trial lawyers are only compensated for damages 30-40% when the plaintiff  does not pay a retainer or pay for services as they are incurred.  In this situation the lawyer is investing time and resources without being paid.  There is no guarantee that they will win the case or be award damages that equates to their expenses.  For taking on risks such as this 30-40% of the award damages is fair.

    The best way to resolve this problem is for insurance companies to stop insuring these risky doctors and companies which have a track record of doing harm to patients.  This is exactly the way its is done for auto insurance.  Good drivers get the best rates, those with a poor driving record pay more, and finally those that consistently abuse the system get no coverage.
