Will US Company have to pay any taxes for my offshore salary?

I am about to takeup a job as an independent contractor for a a US Based S corporation, i am not a US Citizen nor a resident for tax purposes, since i live outside the US, i am assuming i won't be liable for any US Taxes, of course, i will have to pay taxes in my home country. But, will the US company have to pay any taxes, like FICA, Medicare, payroll taxes, etc in the US.

  1. The US looks at two things.

    US Employer of a US person (Citizen or resident), which you say you are not *AND* Payer of US-source work by a non-resident (which this isn't).

    If you are in fact a contractor, they won't pay taxes on you.  They may ask you to sign a document confirming that neither of the above applies to you.  The CANNOT use a form W-9 or a form W-8BEN since those are the two trackable situations and mean the payer intends to give you a 1099-Misc or a 1042-S at the end of the year...and if they do, it will be hard to convince the IRS it isn't taxable.....  


  2. The short answer is, if you are an independent contractor, your employer is not paying FICA for you. Doesn't matter if it is in US or out of US, you are a citizen or not.


  3. You shouldn't be paying any us taxes, they will follow the tax rules of the host country.
