Will a car insurance company pay for Britax carseat replacement after a wreck?

This morning myself and my children were in a pretty bad wreck where the guy hit us coming off the interstate at full speed. We are all shaken up, but physically just sore. My kids ages 4 years & 10 months are all in one piece thanks to their Britax seats, thank goodness.

My van is a goner and I know I have to replace my kids' seats as well. Will this guys insurance cover my kids Britax seats? I know by law they have to pay for other seats, but will they cover over $200.00 for Britax? I want my kids to be in the same seats. My infant daughter was in a roundabout and my 4 year old son was in a brand new (purchased last month) Marathon. I have receipts for neither, because the roundabout was my sons and was purchased 3 years ago so that recpt. is long gone. The Marathon was purchased NEW sealed in the box from a carseat seller on eBay. I have the payapl invoice for it from last month, but no "real" recpt.

  1. Yes, they will pay you for the damaged car seats.  They will likely ask you for a replacement receipt, and deduct for depriciation.   The will also take the old seats as salvage.

    You should be paid in full for the seat that is one month old.  However, if the ACV of your totaled van exceeds the other party's policy limits, you will have to file suit directly against him for compensation.


  2. Good luck getting the insurance company to pay you a dime - I have waited & waited & waited - 6 weeks ago my attorney told me "the check is in the mail" and I wait & I wait & I wait...

  3. As you do not have receipts, the Insurance co will pay to replace the seats less depreciation on the older seats.  See if you can locate them online for pricing purposes and present this information to the insurance co.  They have to reimburse for the same type of seat.

  4. Tell the company that you are making a claim for the replacement of the carseats.

    If you have the paypal invoice, send them a copy.

    Otherwise for the older seat w/ no receipt,  they will look into the cost of a new seat and would deduct for depreciation
