If there is no evidence, sadly the children may be given to the mother. However if there is, yes, of course!

not necessarily, if you get help and follow a treatment pan this might help.also if you did something and the child was in a safe place at the time that makes a diff.most important is to be safe first for you then for your child.

The judge will not need to 'grant' anything. As the next of kin to the child, he will automatically have all say over said child.

oops, I should have read it slower... yes, if the mother has attempted it, and it is documented, he can file for custody... temp or otherwise.
