Will anyone have to pay council tax when i move away?

On the 1st of september 2008 i will be moving out of my property but going to live in Canada.

I know i have to let the council know about this i just want to clear some things up.

I am currently only renting the un-furnished property privately. When i move out who if anyone will have to pay council tax? Will the landlord have to pay anything when i leave despite nobody living there. I just want to get things clear incase he tries to say i must pay something even though i have left or if he says i owe money because he paid council tax when i had gone etc

Basically just the steps the council would take when a person has moved out.

  1. When you're living there you are liable for the Council Tax unless otherwise stated in your lease/letting agreement (sometimes landlords include it).

    When you leave the landlord is liable, although if the property is empty I think he can get an exemption/discount.

    Just give the council your leaving date and don't worry about it further. Keep a record of everything though.


  2. If the owner resides in the property being rented they will remain liable for the Council Tax. If the owner does not live in the property the tenant will become liable for the Tax until such time as their lease/rental agreement ceases. Once the tenant has vacated and the lease/rental agreement has expired, the owner becomes liable for Council Tax. If it remains furnished then a 50% discount will apply. If the property is unfurnished then an exemption will apply for the first six months and then a 50% charge will apply.

  3. Council tax is paid by the private person, therefore if you are not in the country you do not have to pay.

    Poll tax is what used to be paid and it was calculated according to how many people were in the property.  This i snow redundant.

    If you are not living in the country you do NOT have to pay council tax, and neither does your landlord.

  4. Whoever owns the property will need to pay the council tax.

    The only time you dont pay it is when the house is Unlivable. ( IE: no kitchen, no bathroom )

  5. No he will not have to pay anything. A property that is left 'substantially unfurnished' will not be liable for council tax for 26 weeks after this he will get a discount of between 10% and 50 % depending on the council

  6. An un-occupied property has a charge that varies depending on the situation :

    If it is furnished then the discount varies between 50% and 10% depending on the council.

    If it is un-furnished then a Class C exemption applies for up to 6 months followed by a discount between 0% and 50%.

    Once your tenancy is up the property reverts to the Landlord and he is responsible for Council Tax. If you hold the tenancy then you are responsible for Council Tax until the end of tenancy.
