Now it does say violent and unlawful but during the 1950s the CPUSA's constitution forbid using unconstitutional means to take power and that didn't stop McCarthy from throwing them in jail. Even the military allows membership in "totalitarian" organizations as long as no uniform is worn at events. Its 2008 and "liberal" New York prevents Communists, Anarchists, and any revolutionaries from becoming lawyers!

They even use the term "loyalty oath" right out of McCarthy!

  1. Follow my logic here - candidates favoring proletarian rule could possibly be elected if they had a mass movement behind them to overcome the money machines. And measures to socialize the economy could then be legislated, including constitutional amendments. But the results of such elections would INEVITABLY have to be defended in the streets. Then it would be the *COUNTER*revolution that would be an attempt to "overturn by force."

    Thus their formulation does not necessarily apply to those who hold a Marxian conception.

    Another point is that political freedom is supposedly enshrined in the federal and state constitutions in the USA, and this is an obvious violation of that freedom. Are constitutions higher law than statutes?

    I will leave the question as to whether you owe obedience to any laws formulated by the ruling class, and as to whether you should answer whatever you think they want you to answer in order to become a lawyer, for you to decide as an exercise in logic.

    I would never write something online advising you to break the law. That would mean I would be breaking the law myself. And we both know I would NEVER do that!

    By the way, Maoism has severe deficiencies, and more than a few deformations. You really should consider reading some Trotsky. But don't think that ANY left group, regardless of line, is immune to pressures from bourgeois society and will stay "pure." You must be prepared to go into opposition to the leadership of any Marxist group you might join, or else you will have abandoned the concept of democratic centralism. And any group that would object to that statement has already abandoned it.

    And of course Fatgoose has to chime in and show his ignorance. If no leftists could become lawyers, the ACLU would still have almost all of theirs.
