  1. It depends. If you have a refund or rebate due you when you file, it's part of your assets and therefore controlled by the bankruptcy court. If you file your return after filing for bankruptcy, you may or may not receive it depending on what chapter you filed under. You would in a chapter 7, and might in a chapter 13 if the plan allows it.
