Will he be charged with statutory rape if I'm pregnant?

I am sixteen and I'm dating a guy who is nineteen. Recently, my mom has obtained a restraining order against him. If I'm pregnant will he be charged with statutory rape? Please help!

  1. only if someone presses charges, but most likely not since you are only 3 years apart, because they actually will cut some slack if it was consentual..depending on the state.


  2. It depends what the legal age of consent is in your state.  If it is above 16 than yes, he can be charged.

    That said however, if you both deny having s*x and there is no proof to the contrary, then he can't be charged because there is no law against just hanging out with older guys.  That won't do you any good if you are pregnant however because a simple paternity test would definitely count as proof of s*x.

  7. You need to check you states laws on statutory rape because you may be of the age to consent.

    I hate when people sit here and tell you he's going to jail when they have no clue what state you live in and what your age of consent would be.

    Most states a girl can consent between the ages of 15 & 16 and if the guy is less than 4 years older than you it won't be considered statutory rape.  Once a person is of consenting age the parents can't press charges on the other person.

    the mom can press charges, but it will not be considered statutory rape.

  9. If you had s*x, and you would like to charge him with statutory rape, then yes. He will be. Your mother also has the right to file the report, from what I understand. So, if you don't want him to be arrested for rape charges, talk to your mother and try to explain the situation to her.

  10. It's you're parents perogative, they can press charges of statutory rape if they feel so inclined. i think if that is the situation you have more pressing matters to be concerned about!

    The way the law is set up more then likely, however if pregnant he has his fathers rights. If you are pregnant your mom best get used to him in your families life's.....and you need to stay away from boys 18 and older. Have a heart.....

  14. Oh sweetie, that's a bad situation. It's all up to your mother if she wants to press charges or not but she absolutely has grounds too.

    Why would she get a restraining order against him in the first place? Three years isn't that big of a difference, unless she had some reason to think that he was hurting you in some way or another. I hate to sound like a mom, but unless she's totally crazy (can't rule anything out, my mom was kind of whacked too) it's probably best to hear her out and try to understand why she is so concerned. She's your mom after all, everything she does is only to try and protect you because she loves you so much!

    Like I said, my mom was kind of crazy when I was younger and I hated her for trying to interfere in every little thing, but now that I'm a mom I cringe to think of the things I used to say to her just because she was trying to look out for me. I dread the day my daughter is old enough to feel that way about me. Trust me, it might not seem like it now but when you get older and look back, most of the things mom says were right on.   15. depends on where you live and the age of consent, it varies by state and country. Why did she get a restraining order against him? If you are not of age of consent then yes he could be charged with statutory rape, irregardless of what you say.

  16. Yes he could be. It is illegal because technically 16 yrs old isnt old enough to understand their consequences and they are not. but it depends where you live, some laws are different, i believe where Im from (Canada!!!) above 16 is ok but below is bad bad bad! Some places are more strict!

  17. He can be charged with statutory rape even if you aren't pregnant.  It all depends on weather or not your parents want to press charges.  

    This happened to my nephew....he was having s*x with this girl before he turned 18 years old.  He continued having s*x with her after he turned 18 and her parents had him arrested and charged.  Fortunately, they dropped the charges but it could have been very bad for him.  He could have been labeled as a s*x offender for the rest of his life.

  21. yes, doesn't matter if you are having a child or not he will still get in trouble. There are no exceptions in having s*x with someone who is underage, even if you are at the consent age, if he is over 17 he still gets in trouble.

  28. That depends on what your mother plans on doing.  You are only sixteen years old, and my opinion is you shouldn't be having s*x anyways, let alone with a nineteen year old.  When you are older, three years isn't that big of an age gap, but when you are sixteen it is a very big deal.

  31. wow people are so rude, i am 17 and my fiance is 21 and we are having a baby together due in november. If your mom decides to file against him it is possible that he could be charged with it depending on what state you live in. i would look up your state laws. I know in texas 17 is the legal age but only with someone who is i think one or two years older, so i guess technically my fiance could be charged witht he same thing but my family loves him so im not in that situation. Btw whoever said 16year olds shouldnt be having s*x, please what were you doing when you were 16? this question wasnt asking for your moral advice.
