Will he get r.o.r once arrested and in jail?

my boyfriend has a warrant out for his arrest for violating probation..he will be seeing his probation officer tomorrow where he will most likely get arrested...will he get relased on his own recongiance once he is in jail? his court date is not until the end of august. he got arrested for driving while license suspended(he has to answer to that in court at end of august) he got v.o.p. by going to another county while driving

  1. Its very unlikely that he will be released without posting a decent sized bond.

    The whole point of probation is to give someone a second chance...when that person fails in their responsibility they typically get a shock.


  2. When a wanted person surrenders to his probation officer it is common to assume that person is not a major risk of flight, and to allow bail... own recognizance.

    If he gets picked up before he gets to the probation officer, that all goes out the window. So if he sees a police officer he should make a point to attract that officer's attention and surrender on account of his warrant.

    He could do himself a favor by calling the local constabulary and asking whether he should go in or wait at home to be picked up. He should make sure to mention that he is aware of a warrant for his arrest.

  3. He'll most likely have to post a bail bond because he was already on probation.

  4. I agree with the previous answer. He will MOST LIKELY get out on bail and ordered to stay in DAILY contact with his P.O. There is also a slim chance thatt the judge might also consider him to be a "Flight Risk" and order him held without bail until his hearing. His prior arrest isn't helping this situation AT ALL....especially if it was due to some other driving offense.

    Secondly it is very difficult to guess how much time in jail he would be setenced to, because it all goes on a "point system" depending on his prior offenses and the severity of those offenses. If I was to GUESS I would think he is looking at 90 days or less. There could be MORE TIME tacked on for the violation of probation....but perhaps the court will combine the sentences or give him concurrent time....serving both sentences at the same time.

    Thirdly.....why are you dating a guy that OBVIOUSLY doesn't love you enough to stay out of jail??? Time is jail is time AWAY from you....
