Will he have to pay csa????

i am almost 26 weeks pregnant.i am unemployed and am not claiming benefits at the moment.i know who the father of my baby is.he is also unemployed but is claiming job seekers allowance.the babys dad is aware i am pregnant and we are both happy about the baby but do not want to live together or be together,we will both be there for the baby.will he have to pay csa? even if he has the baby at his house half the week?

  1. CSA will only be paid if one parent has full custody from what I understand. Check with citizens advice for a definate answer.

  3. If you claim benefits the CSA will get involved and take five pounds per week from him. If you do not rely on the state then it is up to you whether to involve the CSA or not

Maintenence payments vary by different circumstances, at the moment your ex partner would pay the flat rate, this is the rate for the father who earns more then £5 a week but less then £100 is JSA is counted as income. The flat rate is exactly that, he pays £5 a week to you. But if the baby stays at least one night a week every week with your ex partner that rate will be reduced by a 7th for every night the baby stays over night with your ex. So if the baby stayed there 3 nights a week, you'd only be looking at getting about £3 a week child maintence. When he gets a full time job he will have to pay 15% of his wages in child  maintence but the same reduction applies for any night the baby stays with him!

  6. It seems that changes are being made in the CSA from this year, even if you are on benefits you do not automatically have to use the CSA now, but presumably they would want you to look at other options.  If you are not on benefits any arrangements for maintenance are optional I think.

    They are also going to bring in a £20 a week disregard for people on benefits getting maintenance.

    There has always been a 'good cause' opt-out clause from using the CSA anyway.  

    I'm posting you a link to the National Council for One Parent Families who publish several factsheets, I think you need advice either from them or the CAB, even if you are not both going for a maintenance order you might want to consider a parental responsibility agreement for the child's father, it gives him some rights as the second next-of-kin after you:

  7. Yes,, A payment will be deducted from his job seeker allowance every week, and then if he gets a job it will be taken from that , unless he gives it voluntarily.

    The CSA will expect you to tell them who the father is, i.e. who's on the birth certificate.
