Will i be able to extend my fiance Visa under exceptional circumstances?

Im on a fiance visa.After 6days of my arrival here,i had a fight my partner and she called the police.I spent 15days in prison and im out on bail now.Im charged with GHB without intent.

I was acting in self defense and my my partner had been attacking me since last 3 days.

She droped the charges while i was in prision and wrote many letters to the court asking for opplogy and explaining that it was her fault.

The cps are still charging me for public interst

My partner has a bruise eye and a hairline fracture,but didnot undergo any treatment or medication

My trial begins on 8th september .just 3 days before my visa expires.

My bail condition prohibits me from contacting her, and my passport is confisicated.

My partner still wants to marry me.

Will i able to extend my fiance visa to get married after this court case is finished?

any help will be highly appreciated

  1. alot of what you say does not add up

    self defence? - you caused a hairline fracture

    where domestic violence is concerned your fiancee cannot 'drop the charges'

    your fiancee did not undergo any treatment or medication - so how do you know she had a hairline fracture?

    you both still want to get married? is there money involved?

    No you won't be able to extend your visa under exceptional circumstances


  2. My friend, what you need is a good immigration lawyer.

You need a psychiatrist if you still think you want to marry this person.  This is a seriously dysfunctional relationship that will end in disaster for both of you.  And you've already been in jail, so as soon as your trial is over, if you are let loose, hop on the first plane back to your own country.  Otherwise, you are going to jail, then immigration detention, then deportation.

    With the arrest, jail, etc., you are never going to get a spousal visa if you do marry, so consider yourself fortunate to get out of this relationship alive.

  6. As your visa is just about to expire you are more than likely to be deported.as you have been formally charged, you now have a mark against your name whether you are found guilty or not and the likelihood is that they will not extend your visa due to this.

  7. The CPS must be 98% certain that you are guilty of the charge/s before bring the case to Court.Should you be found guilty your Visa will not be valid and as such you will not be able to enter the UK again.A Fiancee Visa can be extended for a reasonable period in the case of illness etc.I hope this helps you but the chances of you remaning here are slim.
