Will i get in trouble if...

if sighned a notary saying that someone else has guardianship of my kid,but then i found that my kid is being abused but i dont got no proof,can i just go get him from the guardian or will i get in trouble?

  2. Taking the child without the guardian's permission would be considered kidnapping if you have signed papers ending your parental rights to your child-- though I'm a little confused.

    Did you actually sign a Termination of Parental Rights? Or is what you're talking about something other than the TPR? If it's not a TPR, different rules may apply depending on what it actually is. Some states require a court appearance to sign a TPR, some require a judge to sign, and some do not require either. Some allow you to revoke the TPR within a certain period of time, and some do not. You need to check exactly what document you signed, and if you have done what is considered a termination of parental rights in your state.

    I think it would be best to report the abuse to social services and the police.

    If you want to try to get custody of your child back, you should take that up with a lawyer, and depending on the circumstances, maybe with social services. But the abuse is a pressing issue that needs to be dealt with right away and is separate from the custody situation.

    I understand your impulse to just get your child out of a bad situation, but you have a better chance of helping your child get out permanently if you go through legal channels. Unless, of course, you end up in a situation where you see your child is in immediate danger of death or bodily harm, in which case you need to go ahead and act to remove the child, and then immediately go to the police and explain the circumstances.

  3. Contact the police and let them investigate it . If they find any wrong doing " DSS " will be called.

  4. No you cannot go and get him from the guardian.  But you can call children's services on them.  They have the duty to investigate all allegations.

  5. Unless a Court of Jurisdiction awards custody to the person your speaking of, you have full rights to "your" child. When you signed a piece of paper and had it signed in front of a notary, it isn't binding if you should change your mind. If you suspect your child is being abused go get them now!!! Take a constable with you if you think there will be trouble.
