Will i need to apply for the I-131 Travel Document?

I will be applying for the I-130 Petition for Alien Relative after getting married in USA but I have to leave the states two months after to get back to Europe because of my job and coz my husband will be deployed... then i have to get back to the USA when he gets back for deployment....can anyone please help me out with this?

Please note that we wont be applying for the adjustment of status I-485 since we are not planning to live in USA

  1. If you and your husband do not want to live in the U.S., it doesn't make much sense to file an I-130 because that is the petition used to eventually become a resident.

    If you do not plan to apply for adjustment of status, then you will have no basis to support any I-131 application because without a pending I-485 application for adjustment of status, there isn't anyway you would be eligible for approval of an I-131.

    So, bascially, the answer is NO. You do not need to apply for the I-131 travel document because you do not plan to adjust status. If you don't want to live in the U.S., there's no sense in submitted an I-130 either.


  2. Yes, the travel document is for any person granted asylum who wishes to travel outside the country. Go to the local immigration office and inquire about it to get the form, or i think its available online.
