I WAS INSIDE A STORE FRONT WHEN A SUDDEN GUSH OF WATER KNOCKED DOWN SOME CEILING KNOCKING ME TO THE FLOOR. I FOUND OUT FROM A MANAGER THAT THEY'VE HAD LEAKING PIPE/SEWAGE PROBLEMS FOR YRS AND THE OWNERS DID NOTHING.2DAYS LATER THEY CONTACTED MY DAD AND TOLD HIM FOR ME NOT TO HIRE AND ATTORNEY ,THEY WILL FILE PAPER WORK TO THERE INS AND PAY ME. OOOH, BY THE WAY IT WAS'' FEECES & URINE THAT FELL ON ME WITH THE CEILING KNOCKING ME DOWN .. THE AMBULANCE CAME TOOK ME IN THE ER. WHERE I WAS 5HRS, NO BROKEN BONES, '' THANK GOD,; I HIRED AND ATTORNEY ANYWAY ITS BEEN 2WKS NOW,OF EVERYDAY PAIN I TAKE THERAPY DO. IAM OUT OF WORK AND THINGS ARE PRETTY MESSY. I WORK SECURITY 3RD SHIFT & I AM A LIFE INSURANCE AGENT, NOW WITH NO INCOME JUST LIVING OFF WIFES SMALL RETAIL INCOME .''HELP WE HAVE 3 YOUNG KIDS.IAM 28.

  1. Win your case for what?  What kind of INJURIES do you have?  Doesn't sound like you have any INJURIES.

    Your ATTORNEY should be able to tell you what this is worth.

    5 hours in the ER means NOTHING - the average wait for a hangnail here in Houston is 9, or 16 at Texas Children's.

    You'll be lucky to see medical bills covered, IMO.

So why are you not working??  You are feeling terribly sorry for yourself and have dollar signs in your eyes thinking of the huge settlement you are going to get.  So get up off you butt and get back to work.  Keep your attorney as you can probably get some type of settlement from the store, however stop whining about your misery and go back to work.   Oh and your attorney will get about 1/3 of any settlement less and fees.  You are not going to get a big settlement so stop thinking you will, if you insist on taking this issue to court, it can take years.

  4. Define what you think "winning" is. The store's insurance company would have most likely paid your medical bills and for the ongoing therapy you would require. Were you looking to get rich? Or did you just want the store to pay the bills that you ran up for your injuries? If you were looking to get rich, that will be somewhat negated by the 40% you will have to pay an attorney, who will more than likely only get the insurance to pay for your bills anyway. Only now you'll have to come up with 40% of your own money to pay the bills, since your attorney gets paid on what the insurance would have paid you anyway.

    The only time I would suggest hiring an attorney is when there is NO insurance, or when they are refusing to pay what is fair. All they do is slow things down, IMO.
