Will my K1 Fiance visa affect my F1 student visa,since I got suspended from school for a year?

I'm a Japanese student and I was in the U.S. with a F1 student visa. I got suspended for a year in Jan. 2007, and left the country as soon as I got my notice. I am engaged with the same guy who I was dating when I was in college and we are currently engaged to get married. He is filing for K1 visa in order for me to enter the country and work legally. My F1 visa ekspires neks year. Since I was suspended and from and asked to leave the country, will it affect my K1 fiance visa application??

  1. are you still enrolled in school...if not they might give you a hard time...if you are still enrolled your chances of getting it renewed is possible...is your fiance a US citizen....

  2. You left as soon as you got your notice so it shouldn't stop your K-1. It may lead to some questions at the Embassy as it may look like you are using the K-1 as a way back. Just tell the truth and you shouldn't have a problem. You have a history with your fiance that is better than many who get K-1 visas.

  4. It could.  When they scrutenize your K1 visa request, they will see that you were already in the country as a student on an F1.  They may deem that all you are interested in is being in the U. S. of A.

  5. No, it will have no adverse effect on eligibility for a K-1 visa. You stopped going to school, but you did the right thing when you left the U.S. You didn't stay in the U.S. out of status.

    You accummulated no unlawful presence. The trouble you had in school will not hurt your chances to qualify as a K-1.
