Will my brother-in-law get sent back to Mexico for abusing his wife?

He was in the US illegally when he met his wife. Well she is American and they legally married in 1983-thus making him a US citizen. They live here in Texas. Well, he hit her about a year ago, he had to go to anger management, etc, and he had a probation thingy. This is the first time he hit her, he didn't have a criminal history nor did he have a violent domestic history. Last week, he head-butted her (she has a huge bump on her cheek bone,swollen, black and blue in color). She has filed a restraining order and they are awaiting trial next month. They have 5 children together.

Will he get sent to prison? And for how long? What are the chances of him getting sent back to his native Mexico?- Can that be his punishment for spousal abuse? Thanks for all your answers.

  1. If he's now a US citizen, I don't think they can deport him retroactively for having been an illegal when they met, unfortunately.

  3. I'm not sure how that works about revoking citizenships due to criminal acts. I think once you are a citizen its hard to take away. Look up the laws of citizen revoking and see what it has to say. Thats terrible she married him and received that treatment after all she did for him. Hopefully justice is served.

  5. I REALLY DONT THINK HE WOULD GET SENT BACK TO MEXICO.. BUT I DO THINK HE MIGHT GET PUT IN JAIL FOR A TIME. REALLY THE QUESTION SHOULD BE WHY IS SHE STIL WITH THE GUY..?? BUT IN ALL THIS HE NEED HIS AZZ KICKED, WHERE IM FROM PPL DONT TAKE THAT ****. MEN LIKE HIM  NEED TO STAY IN THERE 3RD WORLD COUNTRYS!!!

  6. He should rot in jail for hitting her, but that likely won't happen. It would probably be worse if he actually was sent back to Mexico, but since he is legally a citizen because of the marriage, I don't think deporting him is an option...I could be wrong though...

  8. You never know how the legal system will work out.  Hopefully he just starts praying cause the afterlife may not be so forgiving.
