Will my child be eligible for US citizenship if one parent is a US citizen?

I am a US citizen, born in the US. The mother of my child is a Chinese (PRC) citizen. We are not officially married (registered) in either China or US. We live in China, and our child will be born in China. Do I contact the American embassy?

  1. Did you live in the US for more than 5 years?  Were at least 2 of those years after the age of 14?

    If yes to both, yes, you should go to the closest US Consulate and file a Consular Report of Birth Abroad.  The kid will have US citizenship.


  2. Certain conditions would have to be met before the child is 18 for the child to be considered a U.S. citizen.

    The child must be legitimated under law of child's residence, or

    Paternity established by court adjudication, or

    Paternity acknowledge in writing under oath.

    You must meet the 5 years of physical presence in the U.S. rule with 2 years coming after age 14;

    You must establish the blood relationship;

    You must agree in writing under oath to provide financial support until the child reaches ag 18, and

    the child must be unmarried prior to acquisition of citizenship.

    As the baby isn't born yet, I don't think you'll have any trouble meeting these requirements.


  3. yes if the child was born in the us. if not the you will have to go thought all the while thing as if it was not a child.   But anyway immigration have alot of different rules you might get by.
