Will my father's disability check be lowered due to back child support?

My dad owes over $40,000 in back child support. I am 34 and my brother is 29. My mom has gotten a check for $210 a month for the last 3 months, but she hasn't pursued to get the back child support , she just all of a sudden started getting the checks, could they be taking it out of his disability check? He doesn't get very much as it is and the past is the past so why after all these years are they finally getting her money and where can this be coming from?

  1. It is coming out of his check. They will take out the most they can to pay the child support. Be glad it is that much because my aunt has 2 kids with someone that draws SSI and all they have to pay in child support each month is $60 bucks for 2 kids --can you believe that,

    I would not feel sorry for your dad because was he worried when you were kids needing money?  


  2. Why the heck is she getting checks for you and your brother when you are 34 and 29?? Maybe more info would make this less confusing.

  3. That's probably what is happening... and just because you and your brother are now adults doesn't mean the debt will just automatically disappear.

  4. Child Support debt never goes away. It may be delayed, but will eventually be collected, no matter what the age of the "children" is at the time. The money was ordered by the court to your Mother, not the kids. SSI only has 5 reasons for garnishing their checks. 4 of them are for taxes and the 5th is Child Support.

  6. All this would be so much simpler and saner and fairer if the parent who could best financially support the child got both custody and the entire support obligation.

    Your father is disabled. That means he can't work. He might wish to work, but something is wrong with his mind or body. He's crippled or otherwise unable to perform labor. To keep him alive, society pays him a miserly stipend. Now he doesn't have that. Who is supporting HIM, while the money that was supposed to support him is being given to a woman who doesn't really need it?

    Who is feeding HIM? Who's paying his rent, now that he can't pay it himself? Obviously, either the government, with these odious child support rules, is killing your father, or else the burden of supporting your father is being assumed by unknown third parties, which is hardly fair to whoever those third parties are.

    (One possibility that occurs to me is that, in some of these situations, loving children might be supporting their crippled father while the state steals his money and gives it to the mother, which means that the mother would be indirectly robbing her own children using the government as her accessory, pursuant to laws that were ostensibly created to provide support for those same children. All kinds of unforeseen bad stuff can happen when you separate the right to make a choice from its costs, as modern child support laws do.)

    Child support laws, as they exist presently, are nothing but a very, very sanctimonious extortion racket. Feminist in origin, its purpose is to give women an incentive to abandon their marriages in order to get direct control over the money that their husbands earn. Once she has become pregnant, the woman knows that she can enslave her husband whenever she wants to, and she'll "lower the boom" if she doesn't get her way.

  7. Yes the state will deduct from any source of income, federal tax refunds, state refunds, pension, retirement, etc.  depending on whatever state, they will only go back 7 years.  You can call 1-800-772-1213.
