Will my friend be turned away by British immigration?

My friend arrived in the UK from South Africa on a volenteers visa in 2001. 2002 he applied for a students visa which he got. In 2003 the college which he attended went bankrupt he still managed to renew his students visa right through to 2004 he also held down a full time job. In 2005 he applied for his two year working visa whilst on holiday in South Africa. He was turned down. While he was in Britain he maxed two of his credit cards and got a lap top on credit .My question is when he comes back to britain (even as a visitor) will he get through imigration.

  1. we are talking home office here. they let any! thing through. they are the most incompetent body of fools in the entire world.

  2. Depends on what he is doing now.  Has he established himself in the last three years?  Does his current passport reveal the fact that he worked in breach of his conditions in 2004?  Does he have enough money to maintain and support himself whilst on holiday (visitor)?  Does he in fact intend to visit and comply with the rules or does he intend to work in breach again?  Perhaps the fact that you view his return to S.Africa as a holiday rather than as returning home gives a clue. More questions should be asked on his arrival  given his history and it will really depend on whether he can satisfy the officer of his intentions; of course that will depend on his intentions.

Just visiting you on holiday then he needs enough money, a hotel booking or an appropriate place to stay, a return ticket and something to return to (e.g. family, work, study, plans for the future or any financial commitments)

From the limited information you have given I wouldn't think that he is someone that would be immediately trusted by immigration as he has clearly disregarded the rules (a student visa is to study not to work full time the rules are clear- 20 hrs per week work max term time) in the past and has been turned down for a Working Holiday visa (or possibly work permit).  The reason for being turned down for the visa is probably the major consideration on arrival as a visitor, so whatever that was needs to be put right.

    Edit:

Just to put anyone else's mind at rest and to give you access to even more information the following link will take you to the UKBA site that explains just about everything you will need to know; if you want more or your friend needs more advice then just ring the public enquiries office or he can ring the local High Commission (probably very busy) and all that information will be available.  There are no secrets to the process and the facts cannot be changed and are on record.

The bottom line is that if your friend's situation has not changed then he won't get in and he will need proof of the change.

  3. Your friend sounds retarded.  So yes, we'll probably let him in.

  4. HOPE NOT WERE FULL UP

  5. Frustration - I know you mean well and I am not trying to pick a fight with you but I think you have inadvertently given out advice to help someone who should NOT get through immigration get through!!! He/she has already worked full time on what seems to be a dodgy student visa and has been turned down for a working visa Iwould think for good reason and on top of that runs up debts.  Hopefully immigration will not let this person in - sorry!!

  6. He has had a visa denied.  His prior record regarding visas is a "checkered past," to say the least.  It is highly unlikely that he can get a visa or get through immigration on entry.  Visa denial is in his record and that flag pops up when he applies for visa, goes through immigration at an airport or border checkpoint, stopping things right then and there.

  7. Dose his student Visa still valid? and how long has he been out of the country?

If he is not out of the country for a long time and the visa is still

good he will be in good standing but if not.

Then he could be walking between the rain drops and he may

get very wet when he comes back.

    Good luck to him.>>>>>>>>>>>>>>..

  8. I hope he is not allowed through as he sounds financially very irresponsible.

  9. If he has been turned down for a working visa then he could be seen as a risk and refused entry.

  10. Hi

Don't worry, everyone else gets in, that's the one thing I can't understand (no disrespect to you or your friend) but if anyone wants to bring a pet into the country it has to be quarantined and vaccinated (quite rightly so) and yet humans who are the biggest disease carriers on the planet can virtually come and go as they please.
